I. GENERAL PROVISIONS
1. Definitions
For the purposes of these Terms of Service (hereinafter: "Terms"), the following terms shall have the meanings set forth below:

Website – the website available at https://www.tellmemoretravel.com/
Customer – any natural person, legal entity, or organizational unit without legal personality that uses the Website
Consumer – a natural person performing a legal action not directly related to their business or professional activity
Service – a private walking tour with a professional guide in Polish cities, organized by the Service Provider, including guide services and, where necessary, entrance tickets to tourist attractions
Booking – the placement by the Customer of a binding order for a Service
Agreement – a contract concluded between the Service Provider and the Customer for the provision of Services

3. Scope of Application
These Terms define the rules and conditions for using the Website and for the provision of Services by the Service Provider. By using the Website and making a Booking, the Customer accepts the provisions of these Terms.
II. OFFER AND SCOPE OF SERVICES
4. Description of Services
4.1. The Service Provider organizes private walking tours with professional guides in Polish cities, including but not limited to Krakow, Warsaw, and other locations.
4.2. The Service includes:
Services of a professional, licensed tour guide
Entrance tickets to tourist attractions (if required as part of the particular tour)
Sightseeing of museums, old town, and other attractions according to the tour program description
4.3. A detailed description of each Service, including location, duration, program, price, and special conditions, can be found in the offer available on the Website.
4.4. The Service Provider reserves the right to introduce changes to the offer without prior notice. Changes do not apply to Bookings already made.
III. MAKING BOOKINGS AND CONCLUDING THE AGREEMENT
5. Booking Process
5.1. To make a Booking, the Customer selects the Service of interest on the Website, specifies the date, number of participants, and provides the required personal data.
5.2. After selecting the Service, the Customer is redirected to the shopping cart, where they can review the Booking details.
5.3. The Customer selects a payment method: bank transfer to the Service Provider's account or online payment via the Stripe payment gateway.
5.4. By clicking the "Confirm and Pay" button, the Customer places a binding order (offer to conclude an Agreement).
5.5. After placing the Booking, the Customer receives automatic confirmation of order acceptance at the provided e-mail address.
6. Conclusion of Agreement
6.1. The Agreement is concluded upon receipt by the Customer of Booking confirmation at the e-mail address provided during order placement.
6.2. The confirmation includes:
Booking number
Details of the ordered Service (date, time, number of people, program)
Total price
Payment information
Link to these Terms
6.3. Before the Service begins (typically 24-48 hours before the tour date), the Customer receives an additional e-mail with organizational details, including:
Exact meeting place and time with the guide
Guide's contact details
Additional tour instructions
IV. PRICES AND PAYMENTS
7. Prices
7.1. All prices on the Website are quoted in U.S. dollars (USD). Prices include applicable taxes, including Polish VAT where required by law.
7.2. The Service price includes all elements described in the offer, such as guide services and entrance tickets (if specified as part of the tour).
7.3. The Service Provider reserves the right to update prices listed on the Website. Any price changes do not affect confirmed Bookings.
8. Payment Methods
8.1. The Customer may pay for the Service using one of the following methods:
Bank transfer – to the Service Provider's bank account indicated in the Booking confirmation
Online payment – via the Stripe payment gateway (credit cards, debit cards, other methods available in the Stripe system)
8.2. Payment is required in the full amount of the Service price at the time of making the Booking.
8.3. In the case of payment by transfer, the Customer is obliged to make the transfer within 24 hours of receiving the Booking confirmation. The booking number should be included in the transfer title.
8.4. If payment is not made within the specified time, the Booking may be cancelled by the Service Provider.
V. SERVICE DELIVERY
9. Delivery Time
9.1. The Service is delivered on the date agreed upon during Booking, typically within 1-14 days from the date of making the Booking.
9.2. The Service Provider undertakes to provide the Customer with organizational details of the tour no later than 24 hours before the scheduled Service start time.
10. Customer Obligations
10.1. The Customer is responsible for arriving at the meeting place at the designated time.
10.2. In case of delay:
Private tours: if the Customer is more than 30 minutes late and does not inform the Service Provider or guide, the Service may not be delivered and the fee will not be refunded.
Group tours: if the Customer is more than 5 minutes late, the Service may not be delivered and the fee will not be refunded.
10.3. The Customer is obliged to follow the instructions and recommendations of the guide during the Service.
10.4. The Customer should possess appropriate identification documents and meet the participation requirements specified in the Service offer.
11. Service Provider's Inability to Deliver Service
11.1. If for reasons beyond the Service Provider's control (e.g., guide illness, force majeure, natural disasters, strikes, government actions) it is not possible to deliver the Service, the Service Provider will inform the Customer with appropriate advance notice.
11.2. In such case, the Customer has the right to:
Reschedule the Service to another day (by mutual agreement), or
Receive a full refund of the paid amount
11.3. The refund will be made within 14 calendar days from the date of informing the Customer about the inability to deliver the Service.
VI. RIGHT OF WITHDRAWAL AND CANCELLATION POLICY
12. Right of Withdrawal for Consumers
12.1. Pursuant to Article 38 point 12 of the Polish Consumer Rights Act, the right to withdraw from the agreement within 14 days does not apply to Consumers in the case of agreements for the provision of services related to leisure activities if the agreement specifies the day or period of service provision.
12.2. Since the Services provided by the Service Provider are organized for a specific day and time, the Consumer cannot withdraw from the Agreement based on distance selling regulations.
12.3. The Customer is informed of the above exception before placing a Booking and consents to the commencement of Service provision before the expiry of 14 days from the conclusion of the Agreement.
13. Booking Cancellation Policy by Customer
13.1. The Customer has the right to free cancellation of the Booking and receive a full refund of paid funds if cancellation is made at least 72 hours (3 days) before the scheduled Service start time according to Polish time.
13.2. Cancellation less than 72 hours before Service commencement:
No refund of paid funds is provided.
13.3. No-show:
If the Customer does not appear at the meeting place at the designated time, no refund of paid funds is provided.
13.4. To cancel a Booking, the Customer should contact the Service Provider by e-mail at: tours.tell.me.more@gmail.com, providing the booking number.
13.5. The refund is made within 14 calendar days from the date of Booking cancellation, to the bank account from which payment was made, or in a manner agreed with the Customer.
14. Cancellation by Service Provider
14.1. The Service Provider reserves the right to cancel a Booking in case of circumstances beyond its control, such as:
Force majeure (natural disasters, pandemic, government actions)
Sudden illness or indisposition of the guide
Weather conditions making it impossible to safely conduct the tour
Other unforeseen random events
14.2. In case of cancellation by the Service Provider, the Customer receives a full refund of paid funds within 14 calendar days from the date of cancellation.
14.3. The Service Provider will make every effort to inform the Customer about cancellation with maximum advance notice.
VII. COMPLAINTS
15. Complaint Procedure
15.1. The Customer has the right to file a complaint regarding the quality of the Service provided within 14 calendar days from the date of the completed tour.
15.2. The complaint should be submitted electronically to: tours.tell.me.more@gmail.com, stating:
Booking number
Date of the completed tour
Detailed description of the problem and subject of complaint
Customer's expectations (e.g., refund, compensation)
15.3. The Service Provider will consider each complaint individually, taking into account the specifics of each situation and the quality of Service provided.
15.4. A response to the complaint will be provided no later than 14 calendar days from the date of receipt of the complaint.
15.5. If the complaint is accepted, the Service Provider will propose:
A refund of part or all of the paid amount, or
Organization of a replacement tour, or
Another form of compensation agreed with the Customer
16. Alternative Dispute Resolution
16.1. The Consumer has the right to use alternative methods of complaint resolution and pursuing claims. Information on this subject is available on the website of the Office of Competition and Consumer Protection: https://www.uokik.gov.pl/
16.2. The Consumer may use the ODR platform available at: https://ec.europa.eu/consumers/odr/
VIII. LIABILITY
17. Service Provider's Liability
17.1. The Service Provider is liable for proper performance of the Service in accordance with the concluded Agreement.
17.2. The Service Provider is not liable for:
Damage resulting from Customer's delay
Damage caused by the Customer or third parties
Loss or damage to Customer's personal belongings during the tour
Inability to deliver the Service for reasons beyond the Service Provider's control (force majeure)
17.3. The Service Provider's liability is limited to the amount of the Service price paid by the Customer, unless otherwise provided by law.
17.4. The Service Provider has civil liability insurance for conducted business activities.
18. Exclusion from Participation
18.1. The Service Provider or guide has the right to exclude the Customer from participation in the Service if:
The Customer does not meet the participation conditions specified in the offer
The Customer's behavior poses a threat to their own safety or that of other participants
The Customer is under the influence of alcohol or other intoxicants
The Customer behaves in an aggressive, offensive, or inappropriate manner
18.2. In case of exclusion for reasons specified in section 18.1., the Customer is not entitled to a refund of the paid amount.
IX. PERSONAL DATA PROTECTION (GDPR)
19. Personal Data Controller
19.1. The Personal Data Controller of Customers is the Service Provider: TellMeMore Travel Karolina Koźlicka, VAT ID: 7123491996, address: Kębłów 48A, 21-050 Piaski, Poland.

20. Purposes and Legal Bases for Data Processing
20.1. Customers' personal data are processed for the purpose of:
Performance of the Agreement (Article 6(1)(b) GDPR)
Issuance of invoices or other accounting documents (Article 6(1)(c) GDPR – legal obligation)
Handling complaints (Article 6(1)(c) GDPR)
Direct marketing of the Service Provider (Article 6(1)(f) GDPR – legitimate interest)
Sending newsletters – only with Customer's consent (Article 6(1)(a) GDPR)
21. Scope of Processed Data
21.1. The Service Provider processes the following categories of personal data:
First and last name
E-mail address
Phone number (optional)
Other data provided by the Customer during Booking
22. Data Recipients
22.1. Personal data may be transferred to the following categories of recipients:
Tour guides cooperating with the Service Provider (to the extent necessary for Service delivery)
IT system and hosting providers (Hostinger)
Payment providers (Stripe)
Institutions authorized by law (e.g., tax authorities)
23. Rights of Data Subjects
23.1. The Customer has the following rights:
Right of access to their personal data
Right to rectification of data
Right to erasure of data ("right to be forgotten")
Right to restriction of processing
Right to data portability
Right to object to processing
Right to withdraw consent (if processing is based on consent)
Right to lodge a complaint with a supervisory authority (President of the Personal Data Protection Office)

24. Data Retention Period
24.1. Personal data processed for the purpose of Agreement performance are stored for the period necessary to perform the Agreement and for the period required by law (e.g., tax regulations – 5 years).
24.2. Data processed based on consent (e.g., newsletter) are stored until consent is withdrawn by the Customer.

25.1. Detailed information regarding personal data processing can be found in the Privacy Policy available on the Website.
X. INTELLECTUAL PROPERTY
26. Copyright
26.1. All content posted on the Website, including texts, photos, graphics, logos, videos, as well as the layout and appearance of the Website, are subject to copyright and constitute the property of the Service Provider or have been made available under license.
26.2. Use of content posted on the Website is permitted only for personal, non-commercial use.
26.3. Copying, modifying, distributing, or using Website content in any manner without prior written consent of the Service Provider is prohibited.
XI. FINAL PROVISIONS
27. Changes to Terms
27.1. The Service Provider reserves the right to make changes to these Terms for important reasons, such as:
Changes in legal regulations
Changes in the scope of Services provided
Technological or organizational changes
27.2. All changes to the Terms will be communicated to Customers through publication of the new version of the Terms on the Website and through information on the homepage.
27.3. Changes to the Terms do not apply to Agreements concluded before the date of entry into force of the changes.
28. Applicable Law and Dispute Resolution
28.1. The law applicable to Agreements concluded via the Website is Polish law.
28.2. Any disputes between the Service Provider and the Customer who is a Consumer shall be resolved by common courts competent according to the provisions of the Code of Civil Procedure.
28.3. For disputes with Customers who are not Consumers, the court competent for the Service Provider's registered office shall have jurisdiction.
29. Final Provisions
29.1. Matters not regulated by these Terms shall be governed by Polish law, in particular:
Act of April 23, 1964 – Civil Code
Act of May 30, 2014 on Consumer Rights
Act of July 18, 2002 on the provision of electronic services
Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR)
29.2. If any provision of the Terms is deemed invalid or ineffective, it shall not affect the validity of the remaining provisions.
29.3. These Terms enter into force on October 27, 2025.
